Vielleicht haben Sie sich das auch schon gefragt: warum eigentlich neben dem Arbeitsvertrag noch weitere arbeitsrechtliche Regelungen notwendig sind und wer Arbeitsrecht bestimmt. Ist das Aufgabe des Staates? Gehört das zu einem Sozialstaat? Und ist das auch Sozialpolitik? Oder regeln Arbeitsrecht die Gewerkschaften und Arbeitgeberverbände bzw. Betriebsrat und Arbeitgeber? Welche Rolle spielt die Europäische Union oder das Völkerrecht der UNO bzw. ILO? Und was wird durch Arbeitsrecht im Kern geregelt? Wer gilt als Beschäftigte*r- wer ist Selbständige*r? Welche Rechte haben Arbeitnehmer*innen? Und wer regelt welche Rechte? Exemplarisch soll neben dem Arbeitsvertragsrecht an einzelnen Arbeitnehmerrechten wie Fragerecht bei Bewerbungen, Einstellungen, Befristung, Entlassungen, Betriebsänderung das Zusammenspiel von tariflichem, nationalem und europäischem Recht erarbeitet werden.
Die Antworten werden im und für das Seminar anhand von Fällen und anhand der einschlägigen Rechtsnormen gemeinsam oder in Einzel- oder Gruppenarbeit (selbst) erarbeitet werden.
Ziel des Seminars ist es, die Funktion von Arbeitsrecht und einige grundlegende Arbeitnehmer*innenrechte als Teil fairer Arbeitsbedingungen kennenzulernen ebenso wie die verschiedenen Rechtssetzungsebenen und –akteure, ihre jeweiligen sozialstaatlichen Vorgaben bzw. sozialpolitischen Intentionen sowie die jeweiligen Durchsetzungsmittel. Es handelt sich um ein Arbeitsrechtsseminar mit Schwerpunkt Personalwirtschaft, welches im folgenden Semester mit den Schwerpunkten Entgelt- und Arbeitsbedingungen ergänzt wird. Jedes Seminar kann auch einzeln besucht werden.
Schwerpunktthemen werden sein: Fragen des fairen Umgangs bei der Personalplanung- und gewinnung wie Stellenausschreibung, Bewerbung und Einstellung sowie Versetzung, Befristung, Aus- und Weiter- bzw. Fortbildung, Umorganisation und Kündigung sowie Beschäftigungssicherung, Betriebsänderung und Fremdvergabe

Perhaps you have asked yourself why – beside the employment contract – further regulations in regard to labor legislation are necessary and who is responsible for labor legislation. Is it the responsibility of he welfare state? And is it social policy? Or do the trade union and the employers association or the works council and the employer regulate labor legislation? Which role do the EU (European Union) or the law of nations resp. the ILO play? And what ist the main issue of labor legislation? Who is an employee and who is self-employed? Which rights do employees have? And who regulates which rights? Beside the employment contact laws, we will work both an examples of labor rights, the right for enquiries when applying for a job, recruitement, time-limits, dismissals, change in plant organisation and on the combination of wages regulations and national and European law.
In the seminar we will find the answers by working on cases and on the relevant legal norms individually or in groups.
The purpose oft he seminar ist to get to know the function of labor legislation and some basic rights of employees as a part of fair working conditions and also the different levels of legislation and their actors, their differnet sociopolitical demands or the sociopolitical intentions and the different means of enforcement. This is a seminar about labor regulations with the focus on staff management which will be followed in the next semester by a seminar with the emphasis on wages and working conditions. Each seminar can be attended seperately.
Focal subjects will be questions of fair relations in staff management and recruiting staff like vacancies, application for a job, engagement of employees, transfer, time-limit, training and further education, reorganisation and notice of remination of employment, change in plant, operation and outsourcing. |
